A 13-year-old boy has been charged with murder for allegedly deliberately mowing down a bicyclist in a stolen car — egged on by two other boys, including a gun-waving 11-year-old who laughed as they filmed the deadly crash, according to cops.
Johnathan Overbay was allegedly behind the wheel around 4:40 a.m. May 29 last year when he intentionally swerved off the road and struck Scott Dwight Habermehl, 63, who was biking to his job at the Sandia National Laboratory, according to the Albuquerque Police Department.
The young teen was busted after cops were tipped off to a sickening video of the crash being shared on social media.
It showed a young driver saying he was about to hit the cyclist and accelerating the stolen car — with a young passenger, later identified as 15-year-old William Garcia, urging him not to go too fast, cops said.
“Just bump him, brah,” Garcia allegedly said, with the driver replying, “Like, bump him?”
“Yeah, just bump him,” Garcia then allegedly told him. “Go like … 15 … 20.”
As the car approached the cyclist, an 11-year-old boy in the front passenger seat waved a handgun — and laughed as the front of the vehicle ran into the innocent cyclist, cops said.
Police investigated the deadly crash at the time but only got leads when tipped off about the social media video.
Cops already had cellphones belonging to the 11-year-old and Overbay from previous investigations.
Overbay is also accused of several crimes in the month before the deadly crash, including assault, breaking and entering and more, according to KOB 4.
The accused driver was arrested Monday and charged with murder, conspiracy to commit murder, leaving the scene of an accident involving great bodily harm or death and unlawful possession of a handgun.
Police are still looking for Garcia, who is facing the same charges.
The 11-year-old is too young to be charged with murder, police said, adding they are reviewing what charges can be filed.
The boy was arrested on Tuesday, KRQE reported, identifying him as Messiah Hayes.
He has an extensive criminal history, and is believed to be connected to a series of crimes including shooting, burglary and more, the APD said Tuesday.
